1. Who we are & acceptance
Digital Spoiler is a product operated by 38Shift Ltd, a company registered in England & Wales (company no. 17335669) with its registered office at 128 City Road, London EC1V 2NX("we", "us", or "our"). These Terms of Service (the "Terms") govern your access to and use of our website at digitalspoiler.com and the Digital Spoiler service.
By creating an account, subscribing, or otherwise using the site or the service, you confirm that you are at least 18 years old and that you agree to these Terms. If you do not agree, please do not use the site or the service.
2. Subscribing
You subscribe to Digital Spoiler directly through the website. You choose a plan and a committed term, enter your payment details at Stripe checkout, and your subscription begins once your first payment is confirmed. If you are eligible for our founding pricing, the discount is applied automatically at checkout.
Marketing materials describe our current product and plans. Features may evolve as the product develops, and we make no promise that any particular feature shown in our marketing will exist in its described form.
3. Your term, renewal & billing
Digital Spoiler is sold as a subscription with a minimum commitment of 3 months. We offer 3-month, 6-month, and 12-month terms; longer terms are priced lower per month. You choose your plan and term at checkout, and billing begins immediately once your payment is confirmed.
Your chosen term is a commitment for that period. Unless you tell us otherwise before it ends, a term renews automatically for another term of the same length at the then-current rate for your plan. We will remind you by email before a renewal so you can change or cancel first.
As a founding customer, you lock in 50% off for life against our list price. The founding rate stays with your subscription for as long as it remains active and in good standing, including across renewals.
Payments are handled by our payment processor, Stripe. Your card details are entered with and stored by Stripe, not by us, and Stripe processes each charge on our behalf. Your use of the payment flow is also subject to Stripe's own terms.
4. Cancellation & refunds
You can cancel at any time to stop your subscription from renewing, from the billing portal in your account or by contacting us. Cancellation takes effect at the end of your current committed term, and you keep access until then. Because your term is a commitment, fees already paid or due for the current term are not refunded when you cancel, except as required by law or as set out in our Refund Policy, which forms part of these Terms.
Where a refund is due, it is returned to your original payment method, normally within 5 business days of the request.
5. Availability
Digital Spoiler is a product under active development. We aim to keep the service available but cannot guarantee uninterrupted access, a specific setup date, or that any particular feature or timeline will be met, and timelines can change. You are not charged for a period in which we have not made the service available to you, as set out in our Refund Policy.
6. Acceptable use & accounts
You are responsible for keeping your login credentials secure and for all activity under your account and workspace. Seats are for people in your organization; you agree not to resell access.
You agree not to misuse the site or the service, including by attempting to gain unauthorized access, interfering with its normal operation, scraping at scale, or using it for any unlawful purpose, including sending unlawful communications to leads the service surfaces. You are responsible for complying with the laws that apply to your own outreach.
7. Disclaimers, liability & governing law
The site and the service are provided on an "as is" and "as available" basis. Digital Spoiler surfaces leads and research to inform your work; we make no warranty that any lead will respond, convert, or be accurate in every detail, and no warranty of fitness for a particular purpose, except as expressly stated in these Terms.
To the fullest extent permitted by law, our total liability to you in connection with the service is limited to the amounts you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms limits any liability that cannot be limited under applicable law, including your statutory consumer rights.
These Terms are governed by the laws of England and Wales, and any dispute will be subject to the courts of England and Wales, without affecting any mandatory consumer protections available to you where you live.
8. Changes to these terms & contact
We may update these Terms as the product evolves. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email. Changes never reduce the core protections described here: you can always cancel at the end of your billing period, and your founding rate stays with your active subscription.
